On September 2, 2026, FHR-Illinois LLC entered into Amendment No. 1 to its Development and Host Community Agreement with the City of Waukegan, Illinois, formally revising the phasing, schedule, and certain obligations for the development of the permanent casino facility on the Lakehurst Road/Fountain Square site, including defining a new Phase 1A that will include a 20-room boutique hotel, expanding the permanent facility to approximately 325,000 square feet including a repurposed entertainment venue, extending the outside date for certain development milestones to February 17, 2029, and replacing some default and demolition provisions with a new framework under which delays in opening the boutique hotel are subject to a $750 per day late opening fee as the City’s sole remedy rather than constituting an event of default, provided the fee is paid.
