Chemours, DuPont, Corteva and EIDP agreed to a $455 million multiyear settlement and a $135 million financial assurance reserve with North Carolina and certain local governments to resolve and fund remediation of PFAS contamination associated with the Fayetteville Works facility and related PFAS activities, in exchange for broad releases of PFAS-related claims.

On September 9, 2026, EIDP, Inc., Corteva, Inc., DuPont de Nemours Inc., The Chemours Company, and The Chemours Company FC, LLC entered into a comprehensive Settlement Agreement with the State of North Carolina (through the Attorney General and NCDEQ) and various local governments and water authorities in the Lower Cape Fear region to resolve PFAS-related claims arising from historical environmental releases at the Fayetteville Works facility and from broader PFAS activities. Under the agreement, the settling defendants will pay a total of $455 million in structured annual installments (with initial payments of $25 million to the State and $77.5 million to specified local subdivisions), allocate the bulk of funds to abatement and remediation of natural resources and drinking water impacts, and obtain broad releases of PFAS-related claims by the State and participating subdivisions, subject to certain carve-outs. Corteva and DuPont will also provide $135 million of financial assurance via a Reserve Fund, administered by a third‑party trustee for the sole benefit of the State, to backstop Chemours FC’s remaining obligations under an existing 2019 Consent Order governing PFAS remediation at Fayetteville Works, with rules for triggering State-directed use of those funds if Chemours FC fails to perform and is unable to pay. The agreement further confirms substantial progress and completion of certain Consent Order obligations, sets processes and timelines to finalize remaining drinking water obligations and off-site remediation issues, defines a credit mechanism against future annual payments for certain later PFAS claims, and establishes detailed definitions, payment mechanics, and dispute-resolution procedures, while expressly denying any admission of liability by the companies.
