The U.S. District Court for the Southern District of New York ordered a $719 million disgorgement judgment plus fees and costs against Papaya Gaming in favor of Firy Inc.’s Skillz Platform Inc. subsidiary, significantly increasing Skillz’s expected recovery in a landmark false advertising case.

Firy Inc., formerly Skillz Inc., announced that the U.S. District Court for the Southern District of New York issued an order stating that it will enter judgment against Papaya Gaming for $719 million in disgorgement of unjust profits to Firy’s wholly owned subsidiary, Skillz Platform Inc., plus certain attorneys’ fees and costs, in connection with a false advertising lawsuit under the Lanham Act and New York General Business Law. The ruling, which replaces a prior April 2026 jury award of $420 million in actual damages, represents nearly a $300 million increase and follows the Court’s denial of all of Papaya’s post-trial motions challenging the verdict. The Court also awarded approximately $10 million in attorneys’ fees for 2024 and 2025 and additional litigation costs related to Papaya executives’ invocation of the Fifth Amendment during discovery, with a separate opinion on injunctive relief still to come. Firy stated that it intends to vigorously pursue full collection of the judgment, while cautioning that there can be no assurance as to the timing or amount ultimately recovered, including in light of any appeal or further proceedings.
